In Western Australia, a body corporate cannot commence or carry on proceedings in the Supreme Court otherwise than by a solicitor, and the Court has no inherent jurisdiction to dispense with this requirement under O 4 r 3(2) of the Rules of the Supreme Court. The non-compliance provisions in O 2 do not operate as a dispensing power. Directors' statutory powers under the Corporations Law to exercise all powers of the company do not override this procedural prohibition.
