Section 16A(2)(p) of the Crimes Act 1914 (Cth) requires the sentencing court to anxiously consider the probable effect of sentence on the offender's family or dependants in every case where such factors exist; it is not limited to 'exceptional cases'. Periodic detention periods under s 4(2) of the Periodic Detention Act 1995 (ACT) must be calculated on the head sentence, not a notional non-parole period. Prior good character remains a mitigating factor under s 16A(2)(m) even in white collar fraud cases.
