Where a trial judge makes findings adverse to a plaintiff's credit and appears to accept the defendant's medical evidence, the damages award must be consistent with those findings. A failure to analyse competing expert evidence and explain why one body of evidence is preferred over another constitutes a substantial wrong or miscarriage of justice warranting a new trial.
