Where a strata management statement imposes an obligation on 'owners' of lots, a general clause providing that the statement binds lessees does not extend that specific obligation to lessees; the obligation binds only the class of party expressly identified. The covenant in s 28W(2)(b) of the Strata Schemes (Freehold Development) Act 1973 to 'permit the carrying out' of obligations does not make a lessee liable for breach where the proprietor knew of the offending conduct and failed to exercise its own power to remedy it.
