Where both parties contribute to the purchase of property held as joint tenants, the question whether the presumption of resulting trust is rebutted must be addressed, and objective circumstances are more important than uncommunicated intentions. Evidence that one party's money was used by the other towards the purchase price is relevant both to the quantification of contributions and to rebuttal of the presumption. Failure to trace the source of funds through intermediate transactions (such as the purchase and sale of another property) may constitute arguable error.
