Where de facto partners purchase property in joint names with unequal contributions, the presumption of resulting trust may be rebutted by objective circumstances including the nature of the relationship, the joint legal title, the traceability of contributions to the other party's funds, and the absence of evidence of contrary intention. After separation of co-owners, the doctrine of contribution requires adjustment for unequal payments of mortgage, rates and outgoings.
