Where an offender is convicted of multiple counts of ongoing supply of prohibited drugs under s 25A of the Drug Misuse and Trafficking Act 1985 (NSW) committed over consecutive months, making all sentences entirely concurrent is generally erroneous because the offender's deliberate decision to continue offending over successive months magnifies the harm and must be reflected in the effective sentence. The appropriate mechanism is to stagger commencement dates of non-parole periods.
