A prior criminal record for offences dissimilar to the offence being sentenced does not constitute an aggravating feature under s 21A(2)(d) of the Crimes (Sentencing Procedure) Act 1999 (NSW), and treating it as such constitutes appealable error. Appellate courts should exercise caution in attributing error to sentencing judges based on observations made during argument rather than in the remarks on sentence.
