The value of a motor vehicle is a relevant consideration in assessing the objective seriousness of a deemed larceny under s 154A(1)(b) Crimes Act 1900 (NSW), even where the offender is charged with driving (not taking) the vehicle. Offences under s 154A(1)(a) and (b) are not to be distinguished in seriousness by reference to the sub-section under which they are charged; seriousness depends on all the circumstances. Where an offence does not carry a standard non-parole period, a detailed Way assessment of objective seriousness is unnecessary.
