An indictment signed by a person not authorised under s 126 of the Criminal Procedure Act 1986 (NSW) is invalid, rendering the trial and conviction nullities. The de facto officers principle cannot cure this invalidity. The invalidity cannot be waived by the accused pleading to the indictment.
