Section 21E of the Crimes Act 1914 (Cth) requires a sentencing court to separately specify the sentence that would have been imposed but for the reduction attributable to future assistance undertaken to be provided, as distinct from past assistance already given. A failure to comply with s 21E does not of itself invalidate the sentence, but the appellate court may itself fix the apportionment. The established range for discount for assistance to authorities is 20% to 50%, and where a separate discount for a guilty plea is given, the combined discount may exceed 50%.
