Emotional dependence of a grandchild on a testator, unaccompanied by financial or material dependence, does not qualify the grandchild as a dependent 'eligible person' under s 6(1)(d) of the Family Provision Act 1982 (NSW). The dependence must be direct and immediate, not merely the indirect result of the testator supporting the grandchild's parent. Occasional or even frequent gifts do not establish dependence unless they demonstrate a continuing and substantial responsibility for the grandchild's support and welfare. Where a solicitor's failure to file within the prescribed period is the sole cause of delay, this constitutes sufficient cause under s 16(3)(b).
