A sentence of approximately five years imprisonment is within the appropriate range for grievous bodily harm involving a life-threatening subdural haematoma inflicted on a domestic partner, even before accounting for additional offending. A global sentence of four years suspended after two years is at the lower end of the range where there is a history of violence, breach of domestic violence orders, offending on bail, and absence of remorse. Pre-sentence custody that cannot be declared under s 161 of the Penalties and Sentences Act 1992 (Qld) may be taken into account by reducing the sentence imposed.
