A de facto relationship may continue to exist under s 32DA of the Acts Interpretation Act 1954 (Qld) notwithstanding a prolonged period (here, three and a half years) during which the parties do not share a common residence, where the separation is caused by circumstances beyond the parties' control, both parties intend to resume cohabitation, and substantial regular contact continues. Where a pre-existing de facto relationship is established, the question is whether the evidence is sufficient to show that relationship continued, not whether the evidence of the later period considered in isolation would establish a de facto relationship.
