Inadmissible hearsay evidence inadvertently given at trial does not require jury discharge where the evidence is immaterial to the verdict — either because the issue was covered by extensive direct evidence, or because the defence to which the evidence related could not succeed on the facts regardless. A trial judge's direction to disregard inadmissible evidence may be adequate where the trial is relatively short and the evidence is of marginal relevance.
