The care needs of a severely disabled child who is dependent on the offender as primary carer can constitute exceptional hardship warranting a substantial reduction in the custodial component of a sentence, but not a non-custodial sentence where the offending involves premeditated use of a weapon in a domestic violence context. Further evidence about post-sentencing care arrangements will not be admitted on appeal where the complications were anticipated by the evidence before the sentencing judge.
