A driver who flees from police at high speed owes a duty of care to the pursuing officer, including a duty not to expose the officer to the risks of pursuit, and the officer's deliberate conduct in continuing the pursuit does not break the chain of causation because the officer's free choice is constrained by legal duties. The analogy with rescue cases applies: just as a tortfeasor is liable to a rescuer who is injured responding to the danger created, a fleeing driver is liable to a police officer injured in pursuit. However, a police officer who continues a pursuit at extreme speeds on a two-lane highway at night may bear significant contributory negligence (one-third in this case).
