Where a statutory time limit for doing an act expires on a Saturday or Sunday (a 'holiday' under s.44(3) of the Interpretation of Legislation Act 1984), the time is extended to the next business day, but the act may validly be done on the intervening holiday — the extension provision does not impliedly prohibit performance before the extended deadline. In sentencing serious sexual offenders under Part 2A of the Sentencing Act 1991, a proportionate sentence giving full weight to s.6D(a) (protection of the community as the principal purpose), breach of trust, and other circumstances of aggravation may be sufficient without resort to the disproportionate sentencing power in s.6D(b).
