A strategic plan such as Melbourne 2030 may be treated as 'adopted by a Minister' under s 60(1)(b)(ii) of the Planning and Environment Act 1987 without any formal declaration of adoption; it suffices that it was adopted as a matter of fact. The planning scheme policies supporting higher density housing at locations with good public transport access can support high-rise development at a neighbourhood activity centre, and the absence of a structure plan does not preclude the grant of a permit where there is a detailed policy framework in the planning scheme and adequate material before the Tribunal. Whether a proposal constitutes 'higher density' development is a question of fact and degree.
