A sentencing judge who is asked to take into account pre-sentence detention served on remand on an unrelated charge must clearly state that the matter has been considered and to what extent, so as to inform the court dealing with the unrelated offence. Failure to do so constitutes appealable error. The parity principle requires that where a co-offender who pleaded not guilty, was found to be the ringleader, had prior convictions, and was convicted of an additional offence receives the same sentence as an offender who pleaded guilty with no prior convictions, the sentence will engender a justifiable sense of grievance.
