Where an appeal against sentence contends that no immediate imprisonment should have been ordered, the fact that a significant portion of the non-parole period will be served before the appeal is heard, combined with strong prospects of success, constitutes exceptional reasons for bail. The consideration that the custodial portion of a sentence will be largely served before appeal may have greater weight in sentence appeals where the ground is that a non-custodial disposition should have been made, as refusal of bail would render the appeal nugatory.
