Where a sentencing judge finds co-offenders equally culpable and imposes identical sentences, a successful appeal by one co-offender on personal mitigating grounds can ground a parity-based reduction for the other co-offender, even where the specific mitigating circumstances do not apply to the other, because the sentencing judge's view that culpability was the primary determinant of sentence means the remaining co-offender has a justifiable sense of grievance. A prosecution concession that an appeal should be allowed is not of itself determinative; the court must independently satisfy itself that a different sentence should have been passed.
