The one transaction rule (or continuing episode rule) is a guideline, not a rule, but where multiple offences arise from a single melee during an attempt to avoid arrest, cumulative sentences may produce a total that is beyond an acceptable range, warranting appellate intervention. The transitional provisions in cl 2(1) of Schedule 1 to the Sentencing Legislation Amendment and Repeal Act 2003 (WA) require a sentencing judge to impose a fixed term that is two-thirds of the term that would have been imposed under the former sentencing regime, but these provisions are transitional in nature and will cease to operate at some undefined future time when courts develop a sentencing practice under the new provisions. A sentencing judge is not required to specify the extent of discount for a plea of guilty or other individual mitigating factor.
