For the offence of failing to report an accident under s 55(1) of the Road Traffic Act 1974 (WA), the prosecution is not required to prove the actual value of damage exceeds $1,000; it is sufficient to prove the defendant had no reasonable cause for believing the damage did not exceed that amount. A driver who fails to stop and make any assessment of damage cannot hold such a reasonable belief. There is no obligation on the prosecution to provide pre-trial disclosure of witness statements in WA summary courts, and late disclosure does not of itself ground an adjournment.
