Under s 55(1) of the Road Traffic Act 1974 (WA), the duty to report an accident is excluded only if both conditions are met: the driver has reasonable cause for believing damage does not exceed $1,000 AND the property owner is present or represented at the scene. A driver's failure to properly inspect damage before departing is sufficient to negate reasonable cause for believing damage was below the threshold. Under s 54(1), providing details to a third party rather than to the property owner, their representative, or police does not constitute compliance with the duty to stop.
