A statement of aim or purpose within a restraint of trade clause (such as 'aimed at protecting the confidentiality of its business operations') is not a definitively controlling consideration that limits the operative words of the restraint. The concept of 'confidentiality of business operations' can extend to the identity and requirements of customers, such that a restraint on accepting instructions from clients can be seen as a practical way of protecting that confidentiality. A breach of one limb of a multi-limbed restraint may justify an injunction in respect of an unbreached limb.
