Where a lease is entered into over partly completed premises with an oral agreement for reduced rent until completion, a term will be implied requiring the landlord to complete the building works within a reasonable time, as necessary to give business efficacy to the lease. Damages for breach of such a term, where the tenant relocates to more expensive premises, are limited to the unexpired term of the original lease; recovery beyond that period would place the tenant in a better position than performance of the contract.
