The Court of Appeal held that a partially successful appeal is sufficient to enliven the power to grant an indemnity certificate under s 6 of the Suitor's Fund Act 1951, even where the respondent was not ordered to pay the appellant's costs. The certificate entitles the respondent to recover 50% of its costs of the appeal from the Fund under s 6(2)(b).
