The term 'services' in s 12 of the Retail Leases Act 1994 (NSW) is restricted to fitout of the retail shop (finishes, fixtures, fittings, equipment and related installation services) and does not encompass general outgoings of a shopping centre. Failure to disclose outgoings under s 11 does not render the obligation to contribute void; the sole remedy is the qualified right to terminate under s 11(2). Section 29(b) imposes a statutory requirement that outgoings be 'properly and reasonably incurred', overriding any contrary lease provision by virtue of s 7. The calculation of a lessee's proportionate contribution to outgoings based on total floor space (including vacant premises) does not breach s 30.
