Pre-court procedural requirements such as notice before action and compulsory conference provisions that do not prevent causes of action from accruing or limitation periods from running are procedural for choice of law purposes and need not be complied with when proceedings are brought in another State. Self-characterising provisions in State legislation declaring such requirements to be substantive do not bind courts of other States. The characterisation question is determined by the law of the forum, not the law of the place of the tort.
