In the context of police employment, the duty to provide a safe system of work includes a duty of affirmative action requiring support during traumatic incidents; prior exposure to trauma without adverse reaction does not negate reasonable foreseeability of psychiatric injury from a subsequent intense exposure. A plaintiff who refuses prescribed anti-depressant medication bears the onus under s 151L of the Workers Compensation Act 1987 of proving that refusal was reasonable, and reliance on a family member's non-medical opinion without evidence of its basis will not discharge that onus. The Court divided on whether a defendant whose breach materially contributed to an indivisible psychiatric injury is liable for the whole loss (Spigelman CJ, Campbell AJA) or only the proportion attributable to the breach (Basten JA).
