An applicant seeking to withdraw a guilty plea must do more than assert innocence and put the Crown to proof; the applicant must establish a real question about guilt by putting forward evidence, including independent evidence, of a bona fide defence. Declining to answer questions on self-incrimination grounds in such an application may be treated as some evidence of a lack of innocent explanation for conduct depicted in Crown evidence.
