The principle that individuals must not take the law into their own hands is a manifestation of deterrence and is accordingly attenuated where the offender has an intellectual disability. Where the motive for an offence is retaliation for prior sexual abuse, the need for personal deterrence is considerably lessened if the offence is isolated, but prior similar offences indicate personal deterrence retains weight. Appellate courts should be cautious before finding a justifiable sense of grievance where the same judge sentenced co-offenders at the same time with detailed reasons regarding their respective criminality.
