Bell J imposed life sentences on Adnan Darwiche, Naseam El-Zeyat, and Ramzi Aouad for multiple murders arising from a protracted gang feud, holding that the cold-blooded planning and execution of the killings, and the offenders' willingness to use extreme and indiscriminate gun violence in residential areas, rendered their culpability so extreme as to engage s 61(1) of the Crimes (Sentencing Procedure) Act 1999. The Court held that the relative youth of El-Zeyat and Aouad and the likelihood they were under Darwiche's influence did not displace the application of s 61(1) where each murder displayed very grave criminality and there were no mitigating factors. For the accessorial offender Osman (the driver), the Court imposed determinate sentences with non-parole periods of 22 years for each murder count (partially accumulated), rejecting the submission that his classification as an extreme high security inmate warranted a sentence discount.
