The Judicial Review Act 1991 (Qld) does not apply to decisions of the District Court, as the District Court of Queensland Act 1967 is listed in Schedule 1 Part 2 as an excluded enactment under s 18. The earlier decision in Stubberfield v Webster, which identified a gap permitting Part 5 orders in relation to District Court decisions, is no longer applicable following the amendment to s 18. An inferior court of record has power to seal documents containing scandalous material under r 440 UCPR and its inherent power to preserve order and decency.
