A party who is informed of a judge's personal connections with other parties and expressly states that it is not an issue waives the right to later object on the basis of apprehended bias. Parties to judicial review proceedings have a responsibility to place an accurate record of the proceedings below before the reviewing court. Where both parties are at fault in failing to do so, this may militate against indemnity costs even where the applicant's conduct is otherwise unreasonable.
