Rule 103 of the UCPR, which deems service after 4pm to have occurred the next day, does not operate to cut down the 21-day time limit for service of an application to set aside a statutory demand under s 459G(3) of the Corporations Act 2001 (Cth). A company's nominated supervisor under the QBSA Act does not, by reason of that status alone, owe a common law duty of care to the other party to the building contract, particularly where an elaborate contractual regime governs the parties' rights. Section 43(2) of the QBSA Act does not create a private right of action.
