Where a prisoner's mental health condition goes untreated in prison due to systemic deficiencies in the corrections system, and the prisoner is thereby subjected to a harsher experience of imprisonment than could have been reasonably anticipated at the time of sentencing, this constitutes a proper basis for allowing a sentence appeal and re-sentencing. General deterrence should abate where the offender had a significant psychological history at the time of offending.
