The sentencing discretion may be reopened on the basis of fresh evidence of deteriorating health of an offender's family member where that evidence throws new light on pre-existing circumstances and creates an appreciable risk of serious deterioration in the offender's own health, giving rise to considerations of mercy, even where no error is identified in the original sentencing reasons. The non-parole period was reduced from 20 to 16 months on this basis.
