Where the prosecution relies on the number of cannabis plants to establish a large commercial quantity, a low yield from those plants will not ordinarily call for any appreciable reduction in sentence. The objective gravity of the offence is determined primarily by the scope of the operation and the intention to maximise production, not the actual yield. A maximum penalty of life imprisonment is only of general assistance where the offence is nowhere near the upper end of the scale.
