Where a sentencing judge imposes discrete sentences for multiple offences with comprehensive reasons addressing the circumstances of each offence, the judge is not required to separately explain why each CCE sentence differs from each non-CCE sentence. The Arundell/Grossi requirement for explanation applies only where uniform or near-uniform sentences are imposed without explanation for the differential. Structural comparison arguments between CCE and non-CCE sentences are discouraged. An indictment on a Commonwealth offence signed by a Victorian prosecutor not delegated the powers of the Commonwealth DPP under s 31 of the Director of Public Prosecutions Act 1983 (Cth) is invalid and any resulting conviction must be quashed.
