Immediate release on recognizance for serious white collar offences involving $142,789 in misappropriated funds, committed while on bail and while serving a prior sentence for related offending, is manifestly inadequate. However, on a Crown appeal where the offender has been at liberty for several years without reoffending and has dependant children who would suffer exceptional hardship from imprisonment, the combination of double jeopardy, totality, passage of time, and hardship may justify dismissing the appeal despite the finding of manifest inadequacy.
