When directing a jury on provocation, the objective element must not be stated in terms requiring proportionality between the provocation and the murderous act, nor in terms requiring the ordinary person to react in precisely the same way as the accused. The immediate provocative act must be placed in the context of the background relationship and escalating tensions, as the gravity of the provocation is assessed by reference to relevant characteristics and circumstances of the accused.
