A total effective sentence of nine years' imprisonment with a seven-year non-parole period was upheld for culpable driving causing the death of one child and serious injury to another, where the offender was the children's father, drove at 136 km/h in a 100 km/h zone, and had a blood alcohol concentration of 0.171 per cent. The combination of alcohol and excessive speed, together with the aggravating factor that the victims were children in the offender's care, placed the case at a level where general deterrence was of more than usual importance, and the sentence was within range notwithstanding significant mitigating factors.
