The Vexatious Proceedings Restriction Act 2002 (WA) broadened the scope of vexatious proceedings beyond the 1930 Act to include interlocutory proceedings, proceedings conducted in a vexatious manner, and proceedings that are objectively an abuse of process regardless of the litigant's subjective intention. An extension of time to appeal will be refused where the appeal has no prospects of success.
