A fast-track plea of guilty will usually result in a discount of 20 to 35 per cent, depending on the circumstances of the offence and the plea. While not a legal requirement, sentencing judges should as a matter of desirable general practice expressly state the quantum of the guilty plea discount and identify the factors determining its precise location within the range. A sentencing judge must take into account the effect of cumulative sentences upon any unexpired term being served by reason of parole revocation, and the prosecution bears an obligation to ensure the judge is fully apprised of such terms.
