A sentence of 70 per cent of the effective maximum for negligent transmission of HIV causing grievous bodily harm is appropriate where the offender exploited a young, vulnerable complainant, showed no remorse, and attempted to deceive. The prospect of deportation resulting in loss of minimum security rating, home leave, and work release eligibility may not constitute extra hardship warranting sentence reduction, particularly where these are privileges rather than rights. Roberts-Smith JA held that loss of ameliorations of imprisonment (as distinct from conditions rendering imprisonment more severe) falls outside the scope of the extra hardship principle.
