Evidence of insolvency adduced in earlier security for costs proceedings may be relied upon in a subsequent stay application without the need for updated evidence, and the court may draw an inference adverse to the judgment creditor from the absence of updated evidence of asset values. A bank guarantee ordered as security for first instance costs will not be released pending appeal where the risk of inability to meet a costs order persists.
