A principal under a construction contract may retain security provided by the contractor pending final determination of disputes over adjudicated amounts paid under the Building and Construction Industry Security of Payment Act 1999 (NSW), without contravening s 34 of the Act. The retention is within the contractual purpose of securing the contractor's obligations because the contractual mechanisms may result in the contractor being obliged to repay amounts to the principal. The interim nature of adjudicated amounts means that retention of security pending final determination does not 'undo' the adjudicator's determination or exclude the operation of the Act.
