Judicial immunity conferred on registrars by s 44C of the Judicial Officers Act 1986 (NSW) or at common law extends only to immunity from civil proceedings for damages and certain criminal proceedings at the suit of dissatisfied litigants; it does not exempt registrars from the public service disciplinary regime under which they are appointed. Registrars exercising judicial functions remain subject to disciplinary investigation and action under Part 2.7 of the PSEM Act 2002 (NSW) for misconduct in the exercise of those functions.
